ARTICLE VIII
DISCIPLINE
SECTION 8.01: If any member of Beaufort Chapter VIII becomes aware that another member of Beaufort Chapter VIII has not maintained a standard of conduct acceptable to Beaufort Chapter VII, he shall provide full details to the Beaufort Chapter VIII President and/or Vice President.
SECTION 8.02: The President will thereafter appoint a committee of three (3) regular members, consisting of the Vice President and two (2) other regular members, to conduct an investigation into the allegations. If the member who is being investigated is the Vice-President, the Secretary will fill his position on the committee. The investigation will include an interview with the complainant and the respondent. Prior to the interview, the respondent will be advised in person or in writing (certified mail) of the allegations/complaints against him. The Vice President will report the findings of the committee to the President within thirty (30) days.
SECTION 8.03: If the complaint is unfounded the matter will be dropped and the complainant and the respondent will be so advised by the President.
SECTION 8.04: If the complaint is founded the committee will recommend appropriate disciplinary action in their report to the President. The President will review the report with the committee and when appropriate disciplinary action is agreed upon; the President will advise the respondent and will carry out the said disciplinary action. Notification to the respondent will be done by registered mail.
SECTION 8.05: If the respondent feels that the action taken is not justified, he may appeal to the Chapter Board of Directors by presenting his appeal to the Board in writing within thirty (30) days of the receipt of the notice of said action.
SECTION 8.06: The Board will hear such appeal at the next Board meeting or, if necessary, they will convene a special meeting. The appeal will be resolved by a secret ballot.
SECTION 8.07: The President will advise the members of the outcome of all investigations and/or appeals at the following membership meeting.
SECTION 8.08: The respondent may appeal the Board’s decision to International as per the International Bylaws Article X, Section 10.02. Such appeal must be filed with International within thirty (30) days of the final Chapter Board decision.
SECTION 8.09: The President will advise International in writing should any member’s membership be revoked, providing full details of the incident and any investigation
ARTICLE IX
WEARING OF COLORS
SECTION 9.01 The wearing of the Official Blue Knights Colors is a revocable privilege, given to the members in good standing with Beaufort Chapter VIII and the International.
SECTION 9.02 The location of the official Blue Knights Colors on a vest or jacket will be as follows:
(1) The large Blue Knights Crest will be worn on the back of the vest or jacket and will be centered.
(2) The Blue Knights logo, (top rocker) will be worn above the large crest on the back of the vest or jacket.
(3) The South Carolina VIII logo, (bottom rocker) will be worn below the large crest on the back of the vest or jacket.
(4) The small Blue Knights Crest will be worn on the front right of the vest or jacket, with the "Officer/Director" patch worn approx. 1" below.
(5) The American Flag will be worn on the front left side of the vest slightly higher than all other patches.
6) The black POW / MIA patch will be worn directly below the American Flag.
SECTION 9.03 No other patches other than the Official Blue Knights patches will be worn on the back of the vest or jacket.
SECTION 9.04 Other patches for the front of the vest or jacket must be considered in good taste by the membership. If any member has concerns in reference to a questionable patch, that member will notify either the president or vice-president and the matter be brought before the Board of Directors for approval or disapproval.
SECTION 9.05 If a member resigns or leaves the Blue Knights for any reason they have the option to sell back their Chapter Colors to South Carolina Chapter VIII at a fair market value or keep them with the understanding that they are not to be worn under any circumstances.
SECTION 9.06 When working as a volunteer member with an organization, club or group which is not sponsored by nor affiliated with a Blue Knight function or event, the Official Blue Knight Colors will not be worn.
ARTICLE X
AMMENDMENTS
SECTION 10.01: These By-Laws, or any part thereof may be amended or repealed at any business meeting of Beaufort Chapter VIII by a 2/3 majority vote of those present and eligible to vote (members only), providing that a motion has been duly made and seconded at the meeting prior to the vote, and that notice of the motion and proposed amendment posted on the Beaufort Chapter VIII web page prior to the vote.
SECTION 10.02: Upon approval of the amendment, the Secretary will advise International of the changes, and will provide members with an updated copy of the By-Laws.
ARTICLE XI
General
All references herein to the masculine gender shall include the feminine gender where appropriate. The captions appearing in this instrument are for the purposes of easy reference and shall not be considered a part hereof, or in any way to modify, amend, or affect the provisions hereof.
MISCELLANEOUS DEFINITIONS
GOVERNMENTAL LAW ENFORCEMENT AGENCY OR DEPARTMENT
Any agency that is duly formed and is a State, Province, Nation or Country recognized, whose primary function is to deal directly with the enforcement of criminal and/or vehicle and traffic statures/laws of their respective jurisdictions or is responsible for the prosecution, incarceration or supervision of offenders.
ARREST AUTHORITY
Employees of a Governmental Law Enforcement Agency or Department who must be empowered “by statute” to arrest offenders (other than as a private citizen) at all times while on duty. Said employees must receive monetary compensation (as defined) from their respective agencies.
MONETARY COMPENSATION
1. A salary in its normal meaning or workman’s compensation benefits. If a salary is received, it must be paid directly to the employee by their respective Governmental Law Enforcement Agency or Department.
A. Salary is deemed to mean money received as compensation for work performed, computed by the hour, day, week, month or year.
2. A pension, which shall be considered any plan approved & recognized by a governmental law enforcement agency or department, which provides compensation to an employee when he/she has retired from service whether paid out in instalments or in a lump sum.
